Article 1:

Eligibility of Membership - This auction site Dragonsaye Auctions is only available to people who are legally able to form binding contracts with you and the seller/buyer of an auction item. People who are under the age of 18 are not eligible for membership due to state laws concerning the age of majority. If you do not meet these requirements, you are not eligible to use these auction services.

Article 2:

Dragonsaye Auctions is only providing Internet auction services. We only provide services to people interested in selling and buying merchandise via an Internet auction. We do not have control over the items that are posted in the auction site, and cannot guarantee the authenticity and quality of a said product. We are not responsible for the actions the sellers takes, before, during and after the auction, typographical errors, misprints, loss of merchandise/money, damage or failure of equipment, due to your visit to this auction site. Use of this site is at your own risk and content is presented 'As-Is'

Article 3:

Article 3a: Bidding and Selling - As a user, you may bid and/or sell merchandise using Dragonsaye Auctions service.

Article 3b: As a bidder - you know that placing a bid is a binding contract between you and the seller, and the bid cannot be retracted unless due to mistake by the seller, of typographical error, or other error, due to human error on the seller's part. Once you place a bid, and if you win, you will be obligated to buy the product at the said price you indicated as your bid plus any reasonable shipping fees.

Article 3c: As a seller you must meet these terms- the item that you place up for bids must be real.You must purchase a store banner, which we use to advertise the store on other sites. The cost is $ 13.90, which includes creating the banner to your specifications and 10,000 views. You must keep it active at a cost of $9.99 per 10,000 views and will be billed when the views from the previous purchase have expired. Larger packages are available, see the Banner Rotation Program at the bottom of each page. This fee will not affect your store credit and will have a separate invoice. You must also keep a minimum of 20% of your maximum items for your store. For example if you have a General Store that holds 50 items, you must maintain 20% which is 10 items, Trading Post needs, 20 items, Grand Mall would need 60 itemsand the Mega Mall 100 items, . You must also maintain a current "About This Store" showing YOUR workshop or storage for your materials. If you do not provide this, you will not be allowed to sell on the site until this page is created. This is in an effort to maintain the integrity of the site. Pre-sales are not accepted. Once a bid has been placed for your item, you are entering into a binding contract with the potential buyer of the product, if that bid shall be the highest bid. Once the auction is over, if over reserve price, you are obligated to sell to the potential buyer which is the highest bidder in your auction. If, reserve price was not met, you are not obligated in any way to sell this item at all. As a seller, you are not legally permitted to bid on your own items. This is known as shill bidding. If discovered, your auction will be deleted; you will still be responsible for any fees associated with that listing. You will also be permanently banned from the site. It is the sellers responsibility to fully disclose in each ad their shipping fees and abnormalities in shipping. An example would be if you live a distance from the shipper and only ship once per week.

Promotional: one, where you receive a free credit for listing and has no annual fee for the store for a specific time period. Promotions can be extended or end at any time at the discretion of Dragonsaye Auctions.

When obtaining a promotional store, the seller will retain an active store with a minimum of five items in the store. Please understand that this is a new site and we are doing everything possible to promote the site. We encourage sellers to contact as many past buyers as possible to inform them of this new site. Simply put a note in shipments of current sales from other sources, directing customers to your new store @ Dragonsaye Auctions

Article 4:

Posting Items - As a member, you are welcome to post items for sale using Dragonsaye Auctions services. We do have restrictions on what items you may sell and what you may not sell. You may sell only items related to the lapidary field such as lapidary equipment, tools, supplies, rough, slabs , fossils, minerals, gems, gemstone rough, cabochons, gemstone carvings, hand crafted precious metal jewelry (no costume, plated or base metal jewelry) and periodicals. You may not sell any item not directly related to the lapidary industry. You may not sell illegal merchandise, including pirated software and music, firearms, or anything that is affiliated with violence, pornography, etc. Items that are up to bids are subject to review by Dragonsaye Auctions staff and may be removed without notice, if found in violation of this User Agreement and any other Dragonsaye Auction policies. We reserve the right to change or amend these policies at our discretion. All fees associated with the removal items will be charged to your account.

Article 5:

Auction Charges - Please refer to our Fees Page. Referals for sellers earn $5.00 per person, limit to 2 referals for $10.00 in one calendar month. May be repeated each month. This credit is available to store owners only.

Article 6:

Privacy -- We gather your information so that other members will have access on a need to know basis. Personal information is not traded, given or sold to any one for any reason outside of this site, with the exception of Federal, State or Local Authorities actively investigating criminal activity. Personal information sent to a user regarding a product bought or sold on Dragonsaye Auctions is not to be used for any other purpose, except communication concerning the item won or sold. Violators of this policy will be removed from this site and all fees will be the responsibility of the offender. Any legal fees incurred by Dragonsaye Auctions for the recovery of said fees would be assessed to the account of the registered individual.

Article 7:

Sabotage - posting false, misleading, slanderous, profane or personal information will not be tolerated on Dragonsaye Auctions. If discovered, an investigation will be conducted prior to possible permanent removal from this auction service. Dragonsaye Auctions is not liable in any way for any damages or losses because of removal from this service under any of the policies or articles.

Article 8:

'As-is' - condition, that is without a warranty or condition. is not liable for any damages resulting in an auction, or your visit to the site. Dragonsaye Auctions is in no way responsible for the misuse, abuse, incorrect or misleading ads.

Article 9:

Problem Resolution Service - By joining this auction site, you agree to binding arbitration by Dragonsaye Administration Staff in the event of a dispute between any two parties. Any one individual to include the staff of Dragonsaye Auctions may enact this service. All documentation is kept on file and held in strict confidence and. Results of the arbitration will only be given to the interested parties to protect the rights of all parties. Please read the Problem Resolution page, located on the bottom page links.
